What the option of nationality is
It is a court process that allows children of Brazilians born abroad to assert their Brazilian citizenship. It is needed for those who were not registered at a Brazilian consular office at birth and want to formally confirm their nationality before the authorities.
Who can apply
You can opt for Brazilian nationality if you:
- Are the child of a Brazilian father or mother.
- Have reached the age of majority.
- Live in Brazil.
Required documents
- Foreign birth certificate, with a sworn translation if applicable.
- Proof of residence in Brazil.
- Documents proving descent from a Brazilian citizen.
- Other personal documents, as the case may be.
How the process works
The option is made through a voluntary jurisdiction action at the Federal Court. The lawyer files the documents and follows the whole procedure until court approval.
