Updated October 2026 · Legal review: Isadora Rizzi, lawyer (OAB/PR 75.878)
A foreigner can file the naturalization application without a lawyer. Even so, many people prefer legal guidance, especially when their case has particularities. This article helps you understand when that usually makes a difference.
Can I apply for naturalization on my own?
Yes. The Ministry of Justice system allows applicants to file directly. In simple cases with all documents in order, many people apply on their own.
When legal guidance usually helps
- Doubts about the period: histories with changes in permit type, time abroad or temporary residence before the indefinite permit.
- Reduced period: proving a Brazilian child or spouse, a stable union or another case under art. 66 of the Migration Law.
- Criminal records: old cases, rehabilitation or positive certificates.
- Foreign documents: discrepancies in names, dates or records that need rectification.
- Requests and denials: responding to the authority or appealing.
What good support includes
- Review of eligibility and of the residence count.
- A document checklist specific to the case.
- Review of translations, apostilles and certificates before filing.
- Follow-up of requests until the decision.
How to choose
Check that the lawyer is duly registered with the Brazilian Bar (OAB), which can be verified in the National Registry of Lawyers (CNA), explains the process clearly and gives you a written proposal. Be wary of promised results or guaranteed timelines: the decision always belongs to the authority.
