Family reunion is one of the cornerstones of Brazil’s Migration Law (Law No. 13,445/2017). It allows relatives of Brazilians or of immigrants residing in Brazil to obtain a temporary visa or residence permit to live here. The procedures are set out in Interministerial Ordinance No. 12/2018.
Who can apply?
- Spouse or partner, including in a stable union, regardless of gender.
- Children and stepchildren.
- Parents and other ascendants, descendants and siblings, under the regulation.
- People under guardianship, curatorship or custody.
The sponsoring relative can be a Brazilian or an immigrant with a residence permit in Brazil.
Visa or residence permit?
Those abroad apply for the temporary family reunion visa at a Brazilian consulate. Those already in Brazil can apply for the residence permit directly at the Federal Police.
How do I prove a stable union?
The safest way is a public deed of stable union, made at a notary in Brazil, or an equivalent foreign document, apostilled and translated. Proof of cohabitation also helps, such as joint bills, a shared address and children in common.
Most common documents
- Valid travel document.
- Marriage certificate, stable union deed or birth certificate proving the relationship.
- ID and proof of residence of the sponsoring relative.
- Criminal record certificates, when required.
How long is it valid?
Residence by family reunion follows the status of the sponsoring relative. If the sponsor is Brazilian or holds indefinite residence, the permit can be granted for an indefinite term.
