Foreign investors: residence through company investment and restricted activities

Updated October 2026 · Legal review: Isadora Rizzi, lawyer (OAB/PR 75.878)

Foreigners who invest their own funds in a Brazilian company can obtain an indefinite-term residence permit. The rule is in CNIg Normative Resolution No. 13/2017. For directors and executives, Resolution No. 11/2017, as amended by Resolution No. 49/2024, applies.

What is the minimum investment?

  • R$ 500,000 in a new or existing company; or
  • R$ 150,000 in innovation or basic or applied research of a scientific or technological nature.

For directors and executives: R$ 600,000, or R$ 150,000 with the creation of at least 10 jobs within 2 years.

What must be submitted?

  • A 3-year investment plan, including job or income creation.
  • Registration of the foreign direct investment with the Central Bank and the foreign exchange contract.
  • Registered corporate acts proving the capital contribution.
  • Company documents, including the CNPJ (company tax number).

Are there activities restricted for foreign capital?

Yes. Most activities are open, but some have limits or specific rules, for example:

  • newspapers and broadcasting companies: at least 70% of the capital must belong to native Brazilians or those naturalized for more than 10 years (Constitution, art. 222);
  • acquisition of rural land: limits and authorizations under Law No. 5,709/1971;
  • activities in the border strip, subject to authorization.

Sectors such as civil aviation and healthcare have been opened to foreign capital in recent years. Each activity should be reviewed.
